Can we get a different company to stop using our name? They come up on the search under our name?

Hi mihi3,

That sounds like a matter of trademark infringement. Neither Google employees nor TC's on the forum will be able to answer this question as this is a legal issue that differs depending on where you live and where you advertise. Your best bet is to talk with your own lawyer about it.

In general, it will be a trademark violation if the use causes "confusion in the marketplace". Only a judge can determine that, with the help of your lawyer and possibly the lawyers of those against whom you have a complaint.

Best of Luck!

Pete

Hi,

Do you mean that they use your brand name in the Ads? While Google doesn't have jurisdiction over the registration and management of trademarks as rightly pointed out. It does have policies about it, please read the same below:

http://support.google.com/adwordspolicy/bin/answer.py?hl=en&answer=6118

This should give you a basic idea of what Google allows and doesn't allow and what policies are applicable in which regions.

Google does tend to have some mechanism to complain about trademark violations on its platform, but I suggest you read through these policies in detail and have your documetation ready (trademark registration etc). You may need to consult with a legal team for the same.

Hope this helps.

Nikhil is correct. They cannot use your Brand Name in their own Ads. But they can bid on your brand keywords with their own brand name.
