using a Trademarked name in Ad words

Two employees left our company and set up down the road doing exactly what we do in competition. Our company name is three letters then limited (eg. XYZ Limited). The name has no other context outside of our company name and is a registered trademark along with our logo. Can this company then use our name within their Ad words so that there company comes up ahead of ours in searches for our company name? This causes confusion as the company is on the same industrial estate as us and may contact the wrong company. I am aware if it is a keyword it maybe ok to do so but it is not a term that is industry related outside the parameters of our company name?

 

And wondered where we stood on this??

 

(On this note I have tried to report this in Adword complaints and the form is giving a 500 error)
