Can a competitor use my business' name in their Adwords headlines?

Does it make a difference if my business's name is Trademarked or not?

If I think the competitor is in violation with Google's ad policies, how do I file a complaint?  Would I complete this formm: https://services.google.com/inquiry/aw_tmcomplaint

What is the average time to have my complaint resolved by Google?

Hi Timfrancis,

Welcome to Adword community.I strongly support Info.I would like to add one more thing

If your business name is Generic then it is not  the violation of adword policy.Your business name must be Unique and tradmarked.(Like : Apple.com,Microsoft.com etc.)

If your business name is trademarked then you should definitely launch a complaint to Google.Google will review your complain and take necessary action.
