Adwords violation?

Hi, 

A competitor of ours is using Adwords, and for their titles their using other competitor names including our own. So in the search engine a customer thinks they are clicking a link to a product on our website but it takes them to their website. Is this a violation of google adwords?

Welcome to AdWords Community.

 

If an advertiser uses a trademark term(s) in their ad texts, it's definitely a violation of AdWords policies. But to be practical, Google does not know the actual owner of such trademark till they submit relevant documents to it. 

 

If the word(s) being used by your competitor is your trademark, you can get ahead to file a complaint to Google for the same. Google's trademark policy team will look into it and once the verify your ownership, they will restrict any advertiser to use that term in their ads in the relevant geographies.

Please note: if you do not have the trademark for brand names in question, there's nothing that can be done to stop other advertisers using them.

Simple answer NO.

If you have a trademark on your company name, you can register it with AdWords so that only you can allow who can use it or not.

I beleive you can file a complaint, even if the trademark is not registered. Your competitor violates policies:
Ads that do not lead to a landing page that clearly facilitates the sale of either (i) the goods or services corresponding to the trademark or (ii) parts or components related to the goods or services corresponding to the trademark
Ads using the term in a competitive way, including ads with a landing page selling or facilitating the sale of goods or services of a competitor of the trademark owner
Ads that do not lead to a landing page which provides substantive information about the goods or services corresponding to a trademark.

We had similar problem, the only difference is that we do have a registered trademark. I filed the complaint but it was denied by Google saying only the Trademark owner can file it, but not the representative. Still the competior's ad title was changed in a couple of days, our trademark name was taken away. I guees Google influenced upon the competitor. So you can also try. it will be faster, than to wait till the registration procees ii over.
